Navigating Alimony in Oklahoma: Cheating Spouse Edition
Hi, I’m attorney Clint Hastings. I practice in Tulsa, Oklahoma, and I focus on fathers’ rights. Today, I’m going to talk about the question, why should I have to pay her alimony when she’s the one that cheated on me? Well, I understand why that can be so maddening and frustrating, and honestly, I wish the law were different on that issue. But in Oklahoma, we’re a no-fault divorce state, which means that whether or not she caused the divorce or did bad acts or cheated on you doesn’t weigh into the other division of property or payment of alimony or the other issues in the case.
Now, however, there is an exception if she spent money that was marital or yours on an affair spending, you know, maybe they went on lavish vacations or she gave him money, bought him a car, who knows? But that can be taken into account by the court as far as crediting the marital state or you for that money. I hope this helps. Watch our other videos. Let us know if you have questions and I may make a video about your question. Thanks.
