The Myth of Waiving Child Support

The Pervasive Myth of Waiving Child Support
So guys, I want to talk a little bit about child support and a pervasive myth that seems to still exist, and I want to kind of stamp this out, and it’s not going to be news you like, guys. There is this pervasive myth that you can waive child support, and I’m here to tell you that in many, many cases you cannot.
One thing, you are required to do a computation of what child support would be pursuant to the guidelines, and as a general rule, if you have one parent who has a kid most of the time, or if you have a significant difference in income, the courts will not sign an order that purports to waive child support. But if you want to even go there, you have to actually have specific reasons why the court needs to deviate from the guidelines, why you’re going to do what you’re going to do.
And if the court that is your judge doesn’t think it’s a good reason, they can refuse to sign your order, and you’re stuck. Also, I can tell you right now, if DHS is a part of your case, and they’re a part of a lot of cases, because if your kids are on sooner care, if they get daycare subsidies, if you get any welfare of any kind, and the big one is usually sooner care, they are a necessary party, and that means that they have to sign off on your order. And I can tell you guys right now, they do not like it when you waive child support. So the odds are they will not allow you to do that, and you will wind up having your order kicked back. And I’m going to tell you too, judges typically are going to listen to the DHS attorneys. So just so you’re aware of that, that is not, generally speaking, a realistic option. Someone’s going to pay child support.
Exploring Alternatives and Reducing Liability
Now, there are ways to reduce the liability, and I’m going to talk about that in a future video. But if you have it in your head that, by God, I’m not going to pay baby mama transport, well, you might want to get that idea out of your head unless you’re planning to file her for full custody. And you are looking at a current environment where the preference is for joint. And then it’s who pays is going to depend very heavily on who earns more money.
