How Traffic Offenses Can Impact Custody Cases
Hello, my name is Brian L. Jackson. I’m a Tulsa father’s rights attorney here with Dads.Law, where fathers are not disposable. Last time I talked about criminal offenses, I want to focus specifically on traffic offenses. So is that relevant to child custody litigation?
Short answer is it is, but in most instances, it’s probably not going to seriously impact your rights. The exceptions would be things like not having a child in a child safety seat, not putting a seat belt on the kid. You might have an issue if you got nailed for reckless driving or like aggravated speeding, maybe. Particularly if it involved a child, like if you got caught with a kid in the car, you could have a problem.
But generally speaking, the court’s probably not going to give a squirt about your speeding ticket or your failure to yield. Now the other exception is if it causes a car wreck, especially a bad one, they might cause the family court to take a harder look at how safe you are transporting a child. But generally speaking, I think it’s safe to say a traffic ticket is probably not a serious issue, other than those specific circumstances I described.
