Withholding Visitation
Hi, my name is Clint Hastings. I’m a dads’ rights lawyer here in Tulsa, Oklahoma. I practice family law and I focus on dad’s rights. Today, I want to talk to you about withholding visitation when you suspect there is neglect, abuse, or domestic violence at mom’s house.
When Can You Withhold Visitation?
If you have a good faith belief that any of those things have occurred, you can withhold visitation. If you have evidence for it, you can suspend visitation. However, you can’t just do that and then sit on your hands and go months under that assumption. You need to take action to notify the court that you’ve done so and make reports to DHS or police.
What Steps Should You Take?
You can even bring an emergency motion in front of the court to grant you custody and suspend mom’s visitation or give mom supervised visitation. It’s important to be prudent, reasonable, and exercise discretion when needed. Don’t just sit on your hands and hope the situation resolves itself.
