Video Transcribed: So she’s got a new boyfriend and he’s interfering in your visitation, what should you do? My name is Brian L. Jackson, I’m an Oklahoma father’s rights attorney with dads.law, where dads are not disposable. And today we’re going to talk about dealing with the boyfriend if the boyfriend is interfering in your visits.
As a preliminary matter, if you have a visitation order in place and your baby mama is letting anyone interfere in your visitation rights, if she knowingly participates within that she’s in contempt of court. The unfortunate problem with that is that may give you a remedy against her, but it doesn’t necessarily give you a remedy against him. So what do you do about him?
Well, Title 43 actually thought of that. There is a statute under Title 43 that deals with third parties who assist in or otherwise are involved in interfering in lawful custody and visitation orders and it is a civil tort. In other words, you can sue his ass. And if he’s interfering, you should sue his ass.
Now, what you should not do is get yourself into a situation where you engage in physical violence against this individual. The correct way to handle that situation is to go get legal assistance. Which is generally a good way to handle most situations.
Self-help rarely works out well. In the best case scenario, you hurt your case in family court. Worst case scenario, you end up getting arrested for some kind of criminal charge. So I generally advise against self-help in favor of getting a lawyer and suing somebody’s ass. It’s the American way, ladies and gentlemen.
