Maintaining Contact with Your Child While Incarcerated
Hello, my name is Brian L. Jackson. I’m a Tulsa Fathers Rights Attorney here with Dads.Law. So guys, we talked a little bit about what happens if you’re deployed. What about if you know you’re about to be incarcerated? This is a situation nobody wants to find themselves in, but what can you do to maintain contact with your child while you’re incarcerated?
To some extent, this is going to depend on what your court order says, although if you do something to get yourself incarcerated, there is certainly the risk that the existing court order could be modified. Danielle, quit doing that, she’s going to bite you. The existing court order could be modified because of that, as it would be considered a material change in circumstance.
Arranging Visitation and Communication
However, you may be able to arrange to have visitation with the child while you are in custody. It’s important to explore this option and work with your attorney to see if it’s possible. Another option is to have somebody act as a stand-in to keep in touch. This could be a close relative or a trusted family friend who can facilitate communication between you and your child.
Additionally, writing letters and sending Christmas cards is a great way to maintain a connection. I would advise that you do this regularly, especially if you anticipate being incarcerated for a significant period of time. It’s crucial to avoid a situation where the relationship is at risk of turning into an adoption without consent scenario due to lack of communication.
Going the Extra Mile
At a bare minimum, you should certainly write to your child, send cards, and keep the communication appropriate. If possible, sending gifts can also help nurture the relationship. It’s important to make an effort to maintain that bond to the extent you can, given the circumstances.
And guys, if you are facing the possibility of going to prison and you’re worried about your rights to your child, then you need a good lawyer. One place you can find a good lawyer is Dads.Law, where fathers are not disposable.
