Understanding Child Support Payments

And now we’re gonna talk about the payment of, like the means by which you pay child support. Generally, this is one area that, thank goodness, decrees are typically pretty clear about where you are to pay child support. And usually, you’re gonna come across one of two scenarios. Either you pay it directly to her or you’re gonna pay it to the state central registry and then they disperse the funds to her. And it will spell out how to make the payment. You should follow those directions.
Methods of Payment
One area where there might be some ambiguity is the actual method you use to deliver the cash, especially if you’re paying it to her and not to the state. I always advise my clients to do two things. Always use something, a means to pay that’s traceable, so don’t ever give her cash. And if you’re gonna cut a check, I would do it certified funds and get a receipt from her that she received it. That way there’s no ambiguity that you paid it, the check didn’t bounce, and she actually received the money. So she can’t jam you up for that.
Other ways that you can pay are acceptable, but you should be cautious with them, any electronic wiring system is fine. You can PayPal money to the person or Cash App or any of those methods. But understand that if they charge a fee for withdrawing the money, you still owe the full amount ordered, and if there’s a fee deducted from that, then your payment’s short, and the court will hold that against you, not her.
Considerations and Responsibilities
In other words, the person who’s the obligor who’s paying is the one that’s responsible for making sure they pay the right amount. And that means that you would be responsible for paying that transfer fee. So just be aware of that. Also, if for some reason the charge is back, like for example, if you get a fraud alert or something, that’s gonna be on you too. It’s your responsibility to make sure it’s paid. So however you get that done, it has to be, you have to be sure. Because if she comes back later and says, I never got that money, and you can’t prove she did, it’s gonna get held against you, and you will be held in contempt of court. So that’s how that’s interpreted. That’s how the court’s liable to deal with it.
