Understanding the Costs of Subpoenas
Hi, my name’s Clint Hastings, I’m an attorney here in Tulsa, Oklahoma, and I focus on fathers’ rights. This is the fourth video where I’m discussing subpoenas. One thing that we should discuss is how costly are they? You should know that because you, if you have a case with a lot of witnesses that are needed that aren’t all friendly and not, they’re not all going to be volunteering to come, or even they may have jobs and can’t come if they wanted to, then you’re going to be issuing a lot of subpoenas.
Now the subpoena itself is not very costly for an attorney to do, it can take anywhere from 15, 20 minutes, sometimes 10 minutes, depending on what you need to look up to put information on that subpoena. But the issuance itself isn’t that expensive, but you have to have it served, well actually anyone can serve it that’s over 18, the problem is you want to serve it with a process server or a sheriff so that they can file a proof of service in your case, which is an affidavit saying that it was delivered to that person.
Additional Costs and Factors to Consider
And so that can range anywhere from 50 to 100 bucks on a basic service, but if the person’s hard to find or at a long distance, that can cost more. But that’s your main cost of the subpoena itself, that’s not including what you do of course when the witness comes or when you get the records, that’s a whole other story.
