Harassment Is Aggressive Pressure or Intimidation
Video Transcribed: So you call her asking to talk to your kid, and she brushes you off. Then you call her again, asking for the same thing, and she brushes you off. Then you call her again and ask her the same thing, and she brushes you off.
Only now, you find yourself served with a protective order in Oklahoma saying you harassed her. My name is Brian L. Jackson. I’m an Oklahoma fathers’ rights attorney with dads.law, where fathers are not disposable. Today, I want to talk about, is it harassment to be persistent in trying to get contact with your kid when she’s not letting you have it?
I want to start by going through the definition of harassment per Title 22, under the protective order statute. Harassment is defined as uninvited contact that seriously annoys, threatens, or frightens the person. And that a reasonable person would find annoying, threatening, or frightening, and that served no legitimate purpose.
So, the short answer is if you are contacting her to ask after your kid, legally speaking under Title 22, it is not harassment. However, I’m going to give you…
There’s always a caveat with this stuff because if you do it enough times, it could begin to take on the character of harassment if that’s all you’re doing, and you’re not taking other legal steps to try to revindicate your rights.
So, what I want to tell you to do in that situation is what you should be doing anyway. If she’s not letting you talk to your kid, she’s not letting you see your kid, yes, by all means, continue to politely insist on your rights.
But file something because then it looks like you really are going after “I want my rights.” It’s not, “I’m going to bug the shit out of you,” which is what she will say about you.
Now, if you do get served with that protective order because you did call and ask about your kids enough times to make her do that, or because she’s being an asshole, and it’s a tactic, then you need a lawyer right away.
