Waiting Period for Divorce in Oklahoma

Between the time you file your petition and get your final decree, by statute, a 90-day period has to pass. This is because the legislature hopes that by enacting this law, cooler heads might prevail, people may calm down, people may seek counseling, and avoid the divorce altogether for the best interest of the kids.
Waiving the 90-Day Waiting Period
Now, the judge can waive that 90-day period if they find that there is good cause to do so. What might be good cause? It may be that you’ve already tried marital counseling. It may be that you’ve already separated for a long period of time before filing for the petition.
It may be that you’ve already recently filed once for the divorce, reconciled, and now you’re filing again. All of these things you can ask for a judge to determine to be a good cause to waive the 90-day period.
Final Thoughts and Consultation
Now, most divorces, you won’t be to the final decree within 90 days anyway. The only ones that get done that fast are if you and your spouse are virtually in total agreement about almost everything. In that case, if the parties really want to hurry up and get it done before the 90-day period is up, your lawyer can ask the judge to waive that period.
