Jackson, and I’m a Tulsa Father’s Rights attorney with Dads.Law, we protect fathers’ rights in Tulsa, today, we are going to talk some more about best interest analysis. Today, I want to talk to you guys about what is called mandatory considerations, and for the purposes of this discussion, we’re going to start by going to Title 43. Title 43 is the marriage and divorce statute and contains a lot of the language dealing with the best interest analysis.
We are going to talk about these mandatory considerations. I’m just locating the statute here. Here we go, it’s section 112.2… deals with this. Some of the mandatory considerations include a conviction for domestic abuse within the past five years, residing with an individual who has been subject to the registration requirements with the Oklahoma Sex Offenders Registration Act or any similar act in any other state, residing with a person who has been convicted of a crime listed in the Oklahoma Child Abuse Reporting and Prevention Act, which is section 592, title 57… Residing with a person who is convicted of domestic abuse within the past five years.
If you are subject to the registration requirements, the Oklahoma Sex Offenders Registration Act, or any similar act of the state… If you have been convicted of any crime listed under the Oklahoma Child Abuse Reporting Prevention Act, if you are an alcohol-dependent person or drug-dependent person as established by clear and convincing evidence, and can be expected to in the near future inflict or attempt to inflict serious bodily harm to yourself or to another person due to that, your dependency, if you’ve been convicted of domestic abuse in the past five years, as I mentioned.
Any of those, those are mandatory considerations that basically lead to a presumption against that person or that household being a good placement for the child. It also creates a presumption that supervised visitation should be the order of the day.
So, those are some mandatory considerations that the court will always look at because they’re required by statute.
