Understanding Attorney’s Fees in Divorce Proceedings Clearly
Why is your spouse constantly asking for attorney’s fees in every document she files in court? I’m attorney Clint Hastings. I focus on father’s rights here in Tulsa, Oklahoma, and I’m going to look at this question for you today.
First of all, just because it’s in the documents doesn’t necessarily mean she’s going to get the attorney’s fees. It will end up being an equitable balancing by the court as to whether you owe any of the fees. However, most of your documents that are filed are also going to ask for attorney’s fees.
Understanding Attorney’s Fees
The truth is it’s just pretty standard to put that in all the motions filed or pleadings that are filed to preserve the possibility of getting fees in the end. So a lot of times I’ll have clients that come from other attorneys or whatnot and they’re very upset that they’re going to have to pay attorney’s fees.
Well, it turns out there was no order for them to pay attorney’s fees. It’s just that the wife keeps putting that in their motions, same as we do for our client. So don’t get freaked out about it. You do need to have a good conversation with your attorney about the possibilities of it.
