There Are Ways You Can Reduce Costs
Video Transcribed: Can I waive child support? My name is Brian L. Jackson. I am a father’s rights attorney in Tulsa here with Dads.Law where fathers are not disposable.
I want to talk to you guys about a pervasive myth I run into where people think they can waive child support. Either guys who don’t want to pay and want to insist on trying to get it waived. Or it’s guys where they have custody and the child’s mother is kicking up a fit because she doesn’t want to pay child support. I want to set the record straight on this issue. There’s no way, in Tulsa County, that you’re going to get the court to waive child support. There are ways you can mitigate child support. The major way is by having split time. In other words, if the child’s about half of the time at one parent’s house and half the time at the other parent’s house, that tends to drastically reduce the amount that one parent’s going to pay to the other.
But even then, if there’s a difference in your income, you’re still talking about someone’s going to pay someone. The best advice I can give to you guys, and it’s not what you’re going to want to hear, but it is in fact the best advice I can give you. Understand, someone’s paying someone. If you earn more than her and you all have roughly equal time, you’re going to pay her something. It may not feel good, and you may not be happy about it, but you’re going to pay. Accept that. The reason I say that is, if you are going to insist on trying to fight that battle, and by God, I’m not going to pay, you will waste a lot of resources trying to have that fight. And it’s a fight you are likely to lose because the courts in this county will not waive child support.
I’m going to reiterate that. They will not waive child support. Now, if you’re the one who’s getting paid, it’s on you whether or not how aggressively or at all if you want to enforce it, as long as DHS is in the picture, but there will need to be a child support calculation in your judgment. 99% of the time it’s going to be pursuant to the guidelines. My advice to you is there are battles worth having in court, this is not one of them. You waste your resources trying to fight child support.
