I did a little bit of some videos earlier on search and seizure at public school. So, let’s talk about private schools for a second, because I mostly confine my remarks to public schools.
Let’s talk about private schools for a second. What are your rights there? Basically, it’s going to be governed largely by contract law. There are some notable exceptions, but as a general rule, it’s contract law. If you do have a concern about the way your child is being treated in a private school, one good thing about it is you always have the option to withdraw your child. And if you have a dispute with the school, that might be a good place to start.
Understanding the Role of Contract Law
The reality is that private schools are not held to the same statute, the same constitutional rules, or in many cases, statutory laws that apply to a public school. Private schools can actually, in some cases, even discriminate based on things that would otherwise be considered invidious discrimination. A private religious school is not obliged to admit or retain LGBTQ youth, for instance.
Now, they are generally prohibited from discriminating based on race, because that comes under certain public confirmation laws. And that’s a very long-standing area of law that they’re probably not getting away with that. But as far as other types of discrimination, they can and do.
Understanding Search and Seizure Rights at Private Schools
When it comes to search and seizure, because private schools are private entities on private property and not considered organs of the state, they have more leeway. They can search your child for any reason they want as long as it isn’t contrary to the terms of your contract with that school. While there may be limits to this, such as strip-searching without reason, most of your rights are governed by the contract you have with the school.
