Understanding the Automatic Temporary Injunction
Hi, I’m Clint Hastings. I’m an attorney for men in Tulsa, and I focus on father’s rights. Today, I want to talk to you about what’s called the automatic temporary injunction in divorce cases. That is an injunction that’s put in place in every case by statute upon the filing of the divorce.
Abiding by the Automatic Temporary Injunction
There’s a little tricky language about whether or not it applies when you file the divorce or when the other party is served. For our purposes, I want to advise you to just abide by the automatic temporary injunction upon the filing if you are the person that filed it. Now, if we have to fight the situation or them bringing a what’s called contempt for violating the automatic temporary injunction, we can go into whether or not it was actually in place at that time.
Highlights of the Injunction
Assume that any time either party is filed for the petition, just go ahead and abide by the automatic temporary injunction. And what that does is say there’s a list of things you cannot do. For one thing, you cannot disturb or molest the piece of the other party. This means that you can’t all of a sudden start doing things that interferes with them using property that they may have a marital interest in, or their separate property, or anything like that.
