Get a Lawyer Right Away
Video Transcribed: My name is Brian L. Jackson, I am a men’s rights attorney in Tulsa with Dads.Law. I want to talk to you guys today about what you should do if there’s a worst-case scenario and you put your hands on your wife. This is not a situation any of us want to contemplate. Certainly, it’s nothing that we here at Dads.Law condones, but it is a situation that comes up.
Sometimes you make a stupid ass choice, and now you’ve got to deal with the consequences what do you do to mitigate that situation? First of all, if there’s been physical violence in your household, between you and your wife, leave. Leave now and stay away. Don’t go back there.
That’s the first thing. Now, if you’re approached by the law, remember your Miranda Rights. Shut your mouth. Even if you know you’re wrong, there are ways of handling that. But shut up, don’t talk to the cops. It gains you nothing and there’s no shame in keeping your mouth shut until you can talk to legal counsel. Shut your mouth.
If you are arrested, just keep your mouth shut and don’t resist. I did a separate video recently on what to do if you’re arrested and I would encourage you to check that video out so that if you are arrested, you know what to do. Another thing, if you’re served with a protective order, don’t try to call her and reason with her. Don’t make any contact.
Shut your mouth and pay attention to when that court date is because you don’t want to miss that court date or you can get up to a five-year protective order, and that affects your rights to your kids. It affects your right to own a firearm. If you’ve been drinking or have taken anything, don’t drive.
Those are some main points. I think the big thing to remember, if you’re arrested, don’t talk to the cops. If you get served with a protective order, make sure you make a court date. Leave the house. If you’ve had anything to drink or you’ve taken anything that would impair your ability to drive, don’t drive a car.
Now, if you get served with divorce papers, again, I would encourage you if it’s gone to the point where there’s been physical violence between you and your wife, then you don’t need to be communicating with her other than through counsel. And that brings me to my final major pointer. Get a lawyer immediately. This is a high priority. If you hit someone, male or female, you hit your spouse, that is a crime in most instances. Unless you have a specific defense, it is a crime.
You need a lawyer. You need a lawyer right away. You need a lawyer if there’s a protective order. And if the spouse files for divorce, again, you need a lawyer. The last tip I’m going to give you in that situation is to get counsel involved as quickly as possible, and talk to them about your specific circumstances, what happened, and what you did, and you need to be as honest as possible. I know this is a difficult situation. You might be embarrassed.
You might feel like shit about yourself, but it’s important to tell your lawyer exactly what happened to be as honest as you can. We can’t help you if we don’t know what the hell’s going on.
