When Should I Call DHS in Oklahoma?
When should you call DHS? My name is Brian L. Jackson and I’m a Tulsa Fathers Rights Attorney here with Dads.Law where fathers are not disposable and I want to talk to you guys today about when you should call DHS.
Short answer is if you are dealing with a situation where you are thinking that you need emergency custody right now, in other words you’re thinking your child is in immediate danger in the other person’s care, the other parent’s care, then you your first thing you should be doing even before you call your lawyer is call DHS. You are legally obliged to report it.
So if you become aware of situations and I’ll be I can lay out some specific ones but you kind of know it when you see it. If you if you get an allegation that there was child abuse, like if your kid comes comes home and says says the other parent beat their ass or they have a big bruise on their backside or on their legs or something like that. If there’s any kind of a disclosure about sexual misconduct, they were touched inappropriately, something like that, they witnessed drug abuse, alcohol abuse, drug driving, driving high on weed, any of those situations require an immediate report to DHS and that should be your first phone call.
Why is Reporting to DHS Important?
Obviously if you need if you’re in a position to get the child out of out of harm’s way immediately do so but but then the next thing you do from a legal steps to take standpoint is call DHS. I get a lot of people who will tell me well this this is going on or that’s going on I’m really worried and I ask them okay well did you call DHS and the answer is no. You need to call DHS even if you feel like it’s it’s not a very helpful step that they’re not going to listen to you that they don’t do anything it’s still mandatory because if you don’t and something happens you can get criminally prosecuted.
So in any of those kind of situations you absolutely positively without exception must report it to DHS.
