Understanding Retirement Benefits Court Orders
Hi, I’m father’s rights attorney Clint Hastings in Tulsa, Oklahoma. I get questions from clients that have military thrift saving plans and those are assets that can be divided like a retirement or other asset or financial account. There is a special way you have to do it. It has to be ordered by the court and then there’s a separate special order called a RBCO, which stands for Retirement Benefits Court Order.
That must be filled out with all the appropriate information signed by the court and sent to the people in charge of the thrift savings plan. And then how that is divided as far as what’s fair and equitable is a whole other ball of wax that will be decided in your divorce case. But yes, it is divisible, and also a court can divide it.
