Understanding Drug and Alcohol Use in Custody Cases
Hi, I’m Clint Hastings, a Tulsa child custody attorney here in Tulsa, Oklahoma. Today’s video is part of my ongoing series on parental fitness—the real-world factors judges look at when deciding custody. Today’s topic: drug and alcohol use—a big one. Now, this may seem obvious, but you’d be surprised how often clients try to downplay it. Maybe you’ve had a DUI, an alcohol-related domestic incident, or other charges like public intoxication or being in actual physical control of a vehicle. These aren’t minor details—they’re major red flags in custody court.
Taking Responsibility and Showing Maturity
Even if you’re no longer drinking or using, your history matters. Judges weigh past behavior heavily. If Mom doesn’t have that kind of record, this factor alone can tip the scales in her favor, even if everything else is equal. So what can you do?
Get ahead of it. If you’re struggling with alcohol or drugs, get help now. If it’s in your past but you think it might come up—start testing voluntarily. I’ve had clients begin regular testing weeks before a hearing. By the time we get to court, we can hand the judge clean results and show that not only is it not a current issue, but that you’re taking responsibility for your past.
Providing Evidence and Building Your Case
That shows maturity. That shows stability. And that shows the judge that you’re serious about being a fit parent. Now, if the roles are reversed and Mom is the one with the substance abuse history, gather proof—videos, texts, witnesses, whatever you have. I cover that strategy in other videos.
But this video is about your side of the equation. And let me be clear: if both of you have a history of use, don’t rely on the “we’re even” argument. That’s not how you win custody. Your goal is to be the more stable, more credible parent—not to split the difference.
