How to Properly Prepare Text Messages for Trial

The Importance of Selecting Relevant Text Messages
Over the years, I’ve used thousands of text messages in trials and depositions. Gathering, reviewing, and organizing them is very time-consuming. You can’t just show up with a massive stack of texts and expect to go through them all at trial. Judges won’t have the time. You need to carefully select the relevant messages and be ready to point them out during trial if you want them to have any persuasive impact.
Step 1: Proper Screenshots
The most important step is taking clear screenshots. Many clients provide texts that leave out key identifying information. To use a text message in court, your screenshot should show:

- The contact name or phone number at the top

- The date and time of the message

- Each new message clearly marked in sequence
Authentication Process at Trial
Step 2: Authentication
At trial, the process of admitting texts into evidence is called authentication. For example, I might hand a screenshot to a witness and ask:

- Do you recognize this exhibit?

- Is this a text message from [opposing party]?

- Was it sent on [date]?

- Is that their contact name or phone number?
