As times have changed—and they’ve been changing for quite a while now—women often earn as much or even more than men. So why would the ex-husband be the only one responsible for paying alimony?
Alimony Based on Need and Ability to Pay
The answer is: he’s not. That’s not how it works. Alimony is based on need and ability to pay. The spouse who needs financial support after the divorce may be awarded alimony if the other spouse has the ability to pay—regardless of gender.
So, if you’ve been a stay-at-home dad, or if you simply earn significantly less than your ex-wife, you can absolutely apply for alimony—and you may very well receive it.
Changing Perspectives on Alimony
What’s changed a lot over the last 5 to 10 years is how judges view this issue. There has traditionally been a bias against awarding alimony to men, but that’s something the legal system is working to overcome. Judges now rotate more frequently—at least here in Tulsa—and that’s brought fresh perspectives to the bench.
