Protect Yourself: Diaper Rash Legal Advice
Hi, I’m Tulsa Dads.Law attorney Clint Hastings. I practice here in Tulsa, Oklahoma. I focus on father’s rights, and this is my 25th year in practice. Dads, here’s an important warning: diaper rash may seem minor, but it can quickly become a serious issue in custody disputes.
Understanding the Issue
Guys, you would be shocked at how much litigation arises over something as simple as diaper rash. I see it all the time—accusations that your diapering or cleansing is inappropriate and has caused a rash, sometimes even alleged to the level of abuse.
This can happen for many reasons:
-
- You haven’t taken the time to learn how to properly change a diaper.
-
- Diaper rash happens frequently for a variety of reasons, and your ex may not understand that.
-
- Or, your ex may simply be nitpicking, looking for anything to interfere with your time with the child. Honestly, I see this last one most often.
Protecting Yourself
Still, sometimes it’s an honest mistake. Maybe you didn’t quite learn the right way, or you rely on a relative for help, but you’re not cleansing well enough, not checking diapers often enough, or maybe the diaper doesn’t fit properly. Sometimes it’s even an allergy to the diaper cream you’re using, which can cause a severe breakout and trigger accusations that you neglected diaper changes altogether.
My advice? Make yourself an expert in diaper care. Why? Because you don’t want her filing an emergency motion over diaper rash. Judges often view those concerns as reasonable, meaning you could be forced to defend it without recovering attorney’s fees. And while repeated false accusations might eventually turn in your favor, it’s not worth the time, money, and stress.
Take Action
Also, if your child develops a severe rash—whether from an allergy, poor fit, or anything else—take the child to urgent care before returning them to their mother. That way, you have medical documentation showing you took the issue seriously and acted responsibly. Without that, she’ll argue you ignored a medical issue, and it could be used against you.
Bottom line: don’t let something small turn into a big problem. Learn proper care, be proactive, and protect yourself.
