Right to Remain Silent in Oklahoma Private Schools
What about a private school? What is the child’s right to remain silent in private school? Well, again, since it’s a private school, they’re not a government entity. The Constitution is not incorporated against them. And guys, just for those joining us now, my name’s Brian L. Jackson. I’m an Oklahoma father’s rights lawyer here at Dads.Law. The thing to be aware of, like many of the other issues that I’ve discussed earlier about private schools, the child’s right to remain silent is going to be, if it exists, is directly contingent on, vis-a-vis the school, is directly contingent on contract law. What does the student handbook say about this?
Now, if the school is questioning them at the direct behest of law enforcement, they absolutely do have the right to remain silent and they should exercise it. And probably, if they’ve been doing something that could happen, that for any reason could have any kind of potential criminal fallout, it’s probably still a good idea for them to shut it. And if there’s any question about it, they should shut it.
Understanding Private School Policies
But, the school may very well have the right to remove that child and maybe remove that child permanently for refusing to cooperate. And you may be, again, this may be one of those situations where because it’s subject to private contract law, that may be the bottom line. This is one of those things, again, you want to talk with a good lawyer about it because it’s going to see a lot of this is subject to contract law when you’re dealing with these private schools.
Now, that’s not to say that private schools are bad, nor am I saying public schools are bad. I’m merely saying you’re talking about a completely different body of law for one type of school versus the other. And it’s important to understand and appreciate the differences. And you want to be very familiar with that student handbook when you’re dealing with the private school because that is your, those are your rights vis-a-vis that private school in most situations. So, you want to really know that going into it so you know what it is you’re agreeing to.
