Where Should My Spouse Be Served?

The answer to that question depends on your situation. A process server could serve them at their work, at their home, or at some place they frequent. Many times, our client may not want the other party to be served at work due to, you know, embarrassment and whatnot, and they don’t want their spouse to go through that. Other people, you know, kind of don’t care, and they’re kind of glad to have the spouse embarrassed in some way. I don’t recommend that.
Factors To Consider
Anywhere they can find your spouse is potentially a place to serve them. Sometimes, they might even be home with the spouse, and there’s a knock on the door—and it’s the process server serving the paperwork on the spouse. That’s pretty awkward, I’m told.
But in general, it kind of depends on how hard it’s going to be to serve the person. If we talk with the client, and the client thinks, “Oh yeah, they’ll accept service, they’re not going to try to dodge it or anything,” then what we do is tell the process server to call up that person and see if they can arrange a place to meet. And they may say, “Hey, can you meet me at QuikTrip and accept this service?”
Dealing With Difficult Situations
We’ll talk more about what to do in situations when the spouse may be trying to dodge the service—meaning literally run away—or maybe they’re hiding away. We’ll talk about what that means and what could happen in those situations.
