Have as Many Overnights as Possible
Video Transcribed: How avoid paying child support out of the ass? My name is Brian L. Jackson. I am an Oklahoma father’s rights attorney, and I want to talk to you today about steps you can take to mitigate your child support liability.
Your best defense against child support is going to be having as much time with your child as you possibly can and I’m talking a maximum number of overnights. If you have enough overnights, you get the parenting time credit and the closer you get to 50% of the overnights, the larger the credit gets. So to answer that question in simple terms, that’s your first and best defense, have as many overnights as possible because the more of those you have, the better off you are.
Now, another thing you can do too is if you’re talking about new litigation where a new child support order is going to be entered, or if you’re in anticipating that, for example, if you are dealing with an upcoming divorce, or if you’re dealing with a pregnant girlfriend, start paying child support now, if the kids don’t live with you and keep a record of it. Never give her cash, ever. Keep a record of it. That record can save you some arrearage later because the court can and has to consider it.
Even in the absence of a child support order, you do have a duty to support your kid, so it makes the most sense, start giving her money as soon as possible, just make sure you can document and track it.
You might even talk to an attorney about doing a rough calculation based on the guidelines of what child support’s likely to look like and start paying that. It’ll save you money in the long run, because you won’t have to deal with an arrearage judgment and the interest that can accrue on that arrearage judgment.
