Understanding the Importance of Choosing the Right Lawyer
I’m going to tell you about a big mistake I see lawyers make quite often—and how it can be devastating to a case. It’s also a good example of why your choice of lawyer matters.

The Big Mistake in Courtrooms
The big mistake I see is when lawyers allow witnesses or the opposing party to testify about things they don’t actually have personal knowledge of. It can happen quickly in the courtroom, and if the lawyer doesn’t recognize it and object properly, it can really hurt your case.
Here’s how it happens. Let’s say the opposing party is on the stand testifying. Their lawyer asks, “When did your husband go out of town?” “It was in May, the second week.” “Where did he go?” “Missouri.” “Why did he go?” “He was going there to buy illegal drugs.” “Did he take the kids?” “Yeah, I’m pretty sure he did.” “How do you know that?” “Well, I was told by so-and-so.”
Proper Objections in Court
Now, that last part might be hearsay, but the bigger issue is that the witness doesn’t have personal knowledge of what they’re claiming. They might be guessing, assuming, or repeating what someone else said. They don’t actually know.
Of course, you can take the stand later and deny all of it—but then it’s just your word against theirs. A good lawyer needs to stop that testimony the moment it happens. The proper objection is: “Your Honor, objection—foundation, lack of personal knowledge.”
