Understanding Lump Sum Negotiations
I urge you to think about lump sum negotiations in a divorce. Hi, I’m Tulsa Dads.Law attorney Clint Hastings. I focus on father’s rights. So what do I mean by lump sum negotiations? Well, it’s just that you are offering a lump sum now instead of a payout to last some time. This could be in alimony, it could be about retirement division, it could be about property division, anything.
And the idea being, just like in a lot of things in life, if you can provide something, a bird in the hand now, it is worth to in the bush as they say. A lot of times you can save a significant amount of money doing this because often the other party needs money now and are willing to sacrifice long-term amounts to get it now. So an example, let’s say you are going to split your retirement and usually the court orders 50-50 as to any retirement accrued during the marriage.
Maximizing Your Divorce Settlement
Well, instead of receiving that paid out over a long period or getting her account, you could offer her something, an offset, less money but give it to her now in exchange for letting go of the long-term benefits. Think about this in all aspects of property division and you could end up walking away with 10, 20, 40%, sometimes more, savings in your entire settlement on your divorce.
